These Terms of Service (the “Terms”) govern your access to and use of foydayspa.com (the “Website”), services booked through the Website or our booking platform, and communications received from Fountain of Youth Day Spa (“we,” “us,” or “our”). By using the Website, booking an appointment, purchasing a membership, or opting in to our text-message program, you agree to these Terms. If you do not agree, please do not use the Website or our services.
Fountain of Youth Day Spa is a day-spa business operating in the State of Texas. Contact information is provided at the end of these Terms.
Booking: Appointments may be booked through our online booking platform, by phone, or in person. All appointments are subject to availability.
Cancellation and rescheduling: Please provide at least twenty-four (24) hours' notice for cancellations or reschedules. Cancellations received with less than 24 hours' notice, and no-shows, may be charged a fee up to fifty percent (50%) of the reserved service.
Late arrivals: Arriving more than fifteen (15) minutes late may require shortening or rescheduling of your service so we can honor the next guest's appointment time.
Right to refuse service: We reserve the right to refuse or discontinue service to any guest whose behavior or condition, in our reasonable judgment, creates a risk to our team or other guests, or who is unable to receive a service safely.
Pricing: All prices are posted at the spa and on the Website and are subject to change without notice. The price in effect at the time of service will apply.
Payment: Payment is due at the time of service unless otherwise agreed. We accept major credit and debit cards, cash, and gift cards issued by us.
Gratuity: Gratuity is not included in service prices and is at your discretion.
Gift cards: Gift cards are non-refundable, non-transferable for cash, and may not be replaced if lost or stolen. Gift cards do not expire except as permitted by Texas law.
Paid memberships: Monthly memberships include the benefits and free add-ons listed in the membership agreement in effect at the time of enrollment. Free add-ons are available only while the membership is paid and active.
First-visit promotion: The promotion code “FOY20” entitles a new guest to twenty percent (20%) off a single service at first visit. One use per guest. Cannot be combined with other offers. Not redeemable for cash or gift cards. Expires if unused within ninety (90) days of issuance.
Bring-a-Friend promotion: Where offered, the Bring-a-Friend promotion entitles an existing guest and the friend they bring to twenty percent (20%) off their second visit. One use per guest per promotional period. Not combinable with other offers.
Changes to promotions: We reserve the right to modify or discontinue any promotion at any time.
By providing your mobile number and consenting on our form or through our booking platform, you agree to receive communications from us as follows:
Transactional SMS: Sent through our booking platform, Meevo (appointment confirmations, reminders, service follow-ups). Reply STOP at any time to end transactional messaging.
Marketing SMS: Sent from our salon number, (903) 668-0610 (promotions, specials, membership offers). Reply STOP at any time to end marketing messaging. Marketing SMS are sent only between 8:00 AM and 9:00 PM in your local time zone.
HELP: Reply HELP at any time for contact information and a reminder of opt-out instructions.
Message and data rates: Message and data rates may apply. Frequency varies; marketing frequency typically will not exceed four (4) messages per month.
Consent is not a condition of purchase: You are not required to agree to receive marketing messages to book or pay for services.
If you post a review, comment, photograph, or other content to the Website or a platform affiliated with us, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business.
All content on foydayspa.com, including logos, text, graphics, photographs, and the name “Fountain of Youth Day Spa,” is owned by or licensed to us and is protected by copyright, trademark, and other intellectual-property laws.
Certain spa services may not be appropriate for guests with specific medical conditions, medications, allergies, or who are pregnant or nursing. You are responsible for disclosing any condition relevant to a service, and for following any instructions provided by your service provider.
THE WEBSITE AND OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, FOUNTAIN OF YOUTH DAY SPA AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Fountain of Youth Day Spa and its owners, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses arising out of or related to your breach of these Terms.
These Terms are governed by the laws of the State of Texas. Any dispute shall be brought exclusively in the state or federal courts sitting in Gregg County, Texas.
Before filing any formal claim, you agree to first contact us and allow us thirty (30) days to attempt to resolve the dispute informally.
We may revise these Terms from time to time. The revised Terms will be posted at foydayspa.com/terms with an updated “Effective Date.” Your continued use of the Website or our services after the revised Terms are posted constitutes acceptance.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Website and our services.
